The respondent accused is acquitted of an offence punishable under section 138 of the Negotiable Instruments Act. The basis for acquittal is that the cheque which was dishonoured was not for a debt or legal liability. In my opinion, looking to the provisions of Section 118 and 139 of the Negotiable Instruments Act, the case for grant of leave is made out. Hence, leave granted. Criminal Appeal ______/2016.
