By this application, the applicant is seeking suspension of sentence and releasing him on bail. 2.

Heard learned counsel for the applicant. I have gone through the record and proceedings of Summary Criminal Case No.12890/2016 conviction maintained by the District Judge-10 and Additional Sessions Judge, Nagpur dated 18/07/2025 under which the present applicant stands convicted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1981.

Learned counsel for the applicant submitted that applicant has many arguable points in the present revision. The punishment imposed is for a limited period. The revision would take its own time for final disposal. In the meantime, if the sentence is executed, the revision would become infructuous hence prays for releasing the applicant on bail.

Learned counsel for the applicant further submitted that applicant has deposited the amount of Rs. 2,40,000/- before the Lower Court. Learned counsel for the applicant stated that the applicant is in jail since 18/07/2025. Hence, I pass the following order:

i] The judgment and order of conviction and sentence dated 04/03/2021 in SCC No.

12890/2016 maintained by District Judge-10 and Additional Sessions Judge, Nagpur in criminal Appeal No. 121 of 2021 shall remain suspended during pendency of the present revision.

ii] The applicant be released on bail on his executing a P.R. bond of Rs. 25,000/- with one solvent surety in the like amount.

With these observations, the application is allowed and disposed of.
