O R D E R

(Passed on 09.09.2023) The appellant - Insurance Company is present through it's Counsel. None present for the respondents. The appellant has filed Form 'N' with terms and conditions stating therein that the appellant does not want to proceed with the case and is ready to deposit the amount with interest thereon, if any, and the appellant has no objection to pay the said amount to the claimants and requested that the Court fees, admissible under Rules be refunded to the appellant.

In view of the fact that, the appellant does not want to proceed with this appeal, this appeal is hereby disposed of, as withdrawn. The respondents/ claimants are hereby given liberty to withdraw the amount as per order of the Trial Court.

The requisite court fees, if any, be refunded to the appellant, as per rules.

A copy of this order be supplied to the learned counsel for the parties.
