CIVIL APPLICATION [O] NO.1414/2017 If the judgment of the Family Court is not stayed, the cause for filing the Family Court Appeal would be virtually rendered infructuous. Since in a Family Court Appeal the issues of fact and law would be considered, it would be necessary to stay the effect and operation of the judgment during the pendency of the appeal. The prayer made in the civil application is granted and the judgment of the Family Court is stayed during the pendency of the appeal.
