We have perused the affidavit sworn by one Vaibhav Waghmare, Chief Executive Officer, Zilla Parishad, Washim explaining the situation which has prompted him to take a decision of filing Special Leave Petition against the order of which contempt is alleged. We are convinced that the view expressed by the Chief Executive Officer is a possible view and Rgd.
Order 0907cp314.24 therefore, he cannot be said to be at fault by filing Special Leave Petition. Even the earlier Special Leave Petition on the same cause came to be withdrawn. We accept the explanation tendered by Shri Vaibhav Waghmare, who is now transferred as Additional Development Commissioner at Mantralaya, Mumbai.

As far as the compliance of the order of which contempt is alleged, the learned Counsel appearing for the respondent Zilla Parishad, on instructions from the new Chief Executive Officer, states that within a period of one month from today the order of which contempt is alleged, shall be complied with and compliance report by way of an affidavit will be placed on record.

Since the statement is made on instructions, the same is accepted. As such both Contempt Petitions stands disposed of. The contempt notice stands discharged. 5.
In case the compliance report is not filed by the respondent, liberty to petitioners to mention the matter. JUDGE JUDGE Rgd.
