The challenge raised in this Writ Petition is to the communication dated 29.10.2008 issued by the Ministry of Home Affairs as well as Standing Order dated 15.12.2008. 2.

It is informed by Shri Chaudhari, learned counsel for respondents that aforesaid communication dated 29.10.2008 has been subsequently withdrawn by the respondents by imposing certain conditions. He has referred to the order passed in Civil Application No. 77/2012 dated 19.01.2012 in an identical matter. 3.

Considering the fact that the communication which is under challenge in the present Writ Petition has been withdrawn by the respondents, the cause for prosecuting the Writ Petition does not survive.

In the light of order passed in Writ Petition No. 2915/2009 and as the petitioners continued in service thereafter, the Writ Petition is disposed of as infructuous. The petitioners are at liberty to take such steps as are permissible in law, as
