Heard learned counsel for applicant and learned A.P.P. for State-non-applicant.

At the outset, the learned counsel for the applicant submitted that he wish to withdraw the present application in respect of the applicant no.1 with a liberty to file application afresh after filing of the chargesheet.

Prayer accepted.

In so far as the applicant no.2 is concerned with the assistance of the learned A.P.P. I have gone through the F.I.R. and the other materials placed on record. The applicant no.2 is father of applicant no.1. He is arrested on 26/8/2017.The investigation papers shows that investigation in so far as applicant no.2 is concerned is already completed. There are no allegations against the applicant no.2 in respect of rape or in respect of video clippings. The allegations against him are only to the extent of threats. Hence, following order.

ORDER

I) Application is partly allowed.

II) Applicant no.1 Mayur S/o Prakash Taksande is allowed to withdraw the application with liberty to file application afresh after filing of the chargesheet before the learned Court below.

II) Applicant no.2 Prakash Chokhobaji Taksande be released on bail in connection with Crime No.185/2017, registered with P.S.Dhantoli,Nagpur, for the offence punishable under Sections 376(2) (n),354-C,387,504,506 of the Indian Penal Code on he executing P.R.Bond of Rs. 25000/- with two solvent sureties in the like amount.

III) Applicant no.2 shall not cause any prejudice to the prosecution case.

IV) The application is disposed of.

CRIMINAL APPLICATION (APPP) NO.1566 OF 2017 Application is allowed.
