DATE : September 25, 2019 Challenge in the present writ petition is to the rejection of the application under Section 10 of the Code of Civil Procedure, 1908 seeking stay of R.C.S.No.725/2018 that has been subsequently filed. The suit filed by the petitioners is R.C.S.No.532/2018 which is prior in time.

After arguing the writ petition for sometime Shri A. A. Dhawas, learned counsel for the petitioners submits that an application for clubbing/transferring both the suits for common trial would be moved before the learned Principal District Judge. In view thereof the writ petition is permitted to be withdrawn with aforesaid liberty. Needless to state that if the request made by the petitioners is not accepted, they are free to approach this Court for challenging the same. The Writ Petition is disposed of as withdrawn. No costs. JUDGE
