Heard learned counsel Shri P.S. Patil for the petitioners and learned Additional Public Prosecutor Shri V.P. Maldure for the respondent/State.

After hearing respective learned counsel for the parties, we are not in a position to comprehend exact challenge, whether so called Bank Manager Maharajan, against whom supplementary charge-sheet was to be filed, is available or absconding and whether any action under Section 173(3) has been taken or not is not clear.

The charges framed by the Trial Court are also not made available for perusal of this Court. In this situation, without observing anything .....2/-

on the merits of the controversy, we grant the petitioners liberty to move appropriate application before the Trial Court pointing out relevant circumstances and developments. We also grant liberty to approach again if their grievances survive even thereafter.

The writ petition is accordingly disposed of. No costs.
