This petition takes exception to the order dated 03-09-2024 passed by the learned Civil Judge, Senior Division, Khamgaon (below Exhibit-202) in Special Civil Suit No.16/2016.

ii.

By the order impugned the learned trial Court has rejected the application filed by the petitioners to discard the evidence of respondent No.1-A herein original plaintiff alleging that it is beyond pleadings.

iii.

I am not inclined to entertain the present petition. It would be open to the petitioners to raise this contention at the time of final hearing of the suit.

iv.

The petition is dismissed.
