This is an application under Section 24 of the Code of Civil Procedure for transfer of the proceedings. During pendency of this Miscellaneous Civil Application the matter was referred for mediation and the parties have amicably settled the matter and the terms of settlement dated 30th April, 2014 are filed on record which are signed by the parties and their respective advocates and the learned Mediator.
Learned advocate for the non-applicant Mr.Malke submits that the applicant is residing with the non-applicant. In view of above, the Miscellaneous Civil Application has become infructuous. It is disposed of accordingly. In the circumstances, parties to bear their own costs.
