Heard the learned counsel for the petitioner. 2.

A limited challenge is made to the direction given by the Tribunal by which the applicant was directed to deposit a cost of Rs.5,000/- with the respondent No.4/present respondent No.3 within 30 days from the said order.

We have gone through the record. The original application preferred by the present petitioner was dismissed and while dismissing the cost of Rs.5,000/- was directed to be paid to the present respondent No.3.

Since the Original Application was already dismissed, there was absolutely no propriety in imposing the cost in the peculiar facts and circumstances of the case. 5.

Accordingly, the Writ Petition is allowed.

We set aside the order passed by the Tribunal to the extent the direction to deposit the cost of Rs.5,000/- by the petitioner with the present respondent No.3.
