The applicant is seeking bail under Section 439 of the Code of Criminal Procedure in Crime No. 111 of 2022 registered with Police Station Chimur, Dist. Chandrapur for the offence punishable under Section 420 of Indian Penal Code.

After going through the case diary and the First Information Report, nothing incriminating is found to show that any amount was received by the applicant. Therefore, on mere allegation that he recommended informant to invest the amount is not sufficient to deny bail.

In this case the investigation is completed and the chargesheet has been filed. Thus, considering the nature of allegations and the material collected by the Investigating Officer during the investigation, I am of the opinion that further custody of the applicant is not necessary. Accordingly, I pass the following order. i.

The criminal application is allowed.

ii.

It is directed that the applicant shall be released on bail in Crime No. 111 of 2022 registered with Police Station Chimur, Dist. Chandrapur for the offence punishable under Section 420 of Indian Penal Code, on furnishing P.R.Bond of Rs.25,000/- with one solvent surety in the like amount;

iii.

The applicant shall attend the concerned Police Station as and when his presence is required; iv.

The applicant shall not tamper with the prosecution witnesses;

v.

The applicant shall not leave the jurisdiction of the concerned Police Station without permission of the Court.
