Learned counsel, Mr. Aniket Rangari appearing for accused/respondent has filed his Vakalatnama, therefore Shri Sumeet P. Bodalkar, learned counsel appointed by this Court by order dated 12/03/2024 is discharged. CRIMINAL APPLICATION (APPA) NO. 899 OF 2024 1.

The applicant is produced before the Court by executing non-bailable warrant, as he has not complied with the direction under Section 390 of the Code of Criminal Procedure.

The learned APP now informed that he is not required for any other offence. Considering now the applicant is ready to furnish the surety in appeal against the acquittal, in view of that, I proceed to pass the following order:

a] The criminal application (APPA) No. 899 of 2024 is allowed.

8appeal9.2013.odt b] The applicant shall be released on bail on executing P.R. Bond of Rs. 25,000/- with one solvent surety in the like amount.

c] The applicant who is the respondent in the appeal shall attend the proceedings before this Court on the date of hearing.

The paper-book is already ready. The appeal can be disposed of after two weeks. In view of that, the appeal be listed for final disposal on 23/10/2024.
