Learned counsel for the applicant fairly concedes that if contents of the First Information Report are accepted, an offence is made out. Nonetheless, he made efforts to convince the Court that this is a case of cross-FIR.

In our view, we cannot go into these arguments to ascertain correctness of the version of the either party. Once it is found that ingredients of the offence are made out in the FIR, rest all will have to be left to the investigating agency who shall collect evidence, including the evidence furnished by applicants. We have noted that the present FIR is lodged prior in point of time and the FIR lodged by the applicants is later. This is, therefore, a case where continuation of investigation is necessary.
