DATE : 21/09/2018 The appellant is the convict for the offence punishable under Section 302 of the Indian Penal Code and is sentenced to suffer rigorous imprisonment for life and to pay a fine of Rs.5,000/-. The application for suspension of sentence and grant of bail was rejected by this Court and expeditious disposal of appeal was directed. On three occasions earlier, i.e., on 20/3/2017, 13/11/2017 and 20/3/2018 the appellant was granted conditional bail to enable him to appear for the LL.B. examination. This criminal application is made for grant of temporary bail for 47 days from 11/10/2018 to 26/11/2018.
2109appa861.18.odt We do not find any impediment in allowing this criminal application. The appellant/applicant upon his release on earlier three occasions did not misuse the liberty and returned to the Prison within time. There is no complaint.
In view of above, this criminal application is allowed. The applicant shall be entitled to be released on conditional bail for a period of 47 days from 11/10/2018 to 26/11/2018 on furnishing P.R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like amount. The applicant shall attend the Police Station Jaripatka, Nagpur on every Sunday during the period of his release between 4:00 p.m. to 5:00 p.m. The applicant shall submit his latest residential address and also the address of one of his nearest relatives along with contact numbers to the Police Station Jaripatka, Nagpur. In addition to this, the authority shall be at liberty to impose conditions as shall be deemed fit by it.
