On hearing the learned Counsel for the petitioner, we find that several disputed questions of facts would arise for consideration in this writ petition. It would be proper for the petitioner to file a civil suit, wherein the parties can tender evidence both oral and documentary and the issues could be decided.
Mrs. Deshpande, the learned Counsel for the petitioner seeks permission to withdraw the writ petition. Permission to withdraw the writ petition is granted. The writ petition is disposed of as withdrawn. The points raised in the petition are kept open.
