By present petition, the petitioner is seeking an order of injunction against the respondents to not enter and obstruct the petitioner's business and his franchise and further to not consider the business activity of petitioner as gambling activity. 3.

Learned A.P.P. is right in contending that the petitioner's prayer is not maintainable. Firstly because the respondents viz. police officials cannot be restrained from performing their duty in the sense, they cannot be restrained from entering into a premises when they have a reason to believe that the premises are being used for illegal activities. Secondly, to find out whether the petitioner's business in the name of franchise or otherwise is involving gambling activity, the police officers will have a right to take appropriate action. 4.

Thus, the petitioner is expecting this Court to pass a blanket order to prohibit respondent from performing official duty, which is not permissible.

The writ petition is accordingly dismissed.
