Out of matrimonial discord, Petition No.A-76/2016 came to be preferred before the Family Court, Akola by the non-applicant husband under the provisions of Section 13 (1) (i-a) of the Hindu Marriage Act, 1955 for dissolution of marriage.

The wife since staying at Yavatmal, sought transfer of the same, as according to her she is not getting maintenance from the nonapplciant husband and it is difficult for her to travel to Akola and to defend the said matter.

The claim is opposed by the Counsel for respondent-husband on the ground that distance between Yavatmal and Akola is not more than 100 Kms. and the applicant can very much attend the said proceedings.

Having considered the submissions and after having perused the record, as is brought before this Court, what could be noticed is admittedly, the applicant-wife is not getting any maintenance from the non-applicant husband.

In view thereof, Miscellaneous Civil Application stands allowed in terms of prayer clause (1).
