This is the second bail application filed by the applicant.

After hearing the parties and perusing the record, it appears that previously, when the disinclination to grant the bail was shown, the learned counsel appearing for the applicant has withdrawn the application. As the Court has granted anticipatory bail to another co-accused, on change of circumstance, the applicant has filed the bail application before the trial Court and the trial Court has dismissed the application in default as the advocate was not present. The learned counsel for the applicant has stated that it was not heard by the trial Court on merits. Hence, requested to Kavita
2 / 2 4-aba 649-25 permit him to withdraw the application with liberty to file it before the trial court afresh.
3. As the applicant was not heard on merits, permission is granted to withdraw the application with liberty to file it afresh before the trial court.
