By this application, respondent nos. 1 to 5 seeks permission to withdraw the amount deposited by the appellant before the registry of this Court.

It is stated that respondent no.1 is 70 years old, respondent no.2 is 78 years and Respondent no.3 is 82 years of age and they are facing some physical ailment due to old age. In addition to this there are other reasons are also given in the application.

Learned Counsel for the appellant strongly objected the application.

Considering the reasons stated in the application and the fact that amount of Rs.89,14,530/- is being deposited with this Court, the respondent nos. 1 to 5 are permitted to withdraw the amount of Rs.30 lakhs from the said amount subject to usual undertaking and satisfaction of the Registrar (Judicial).

It is further pointed out that being old aged person, the amount may be allowed to withdraw through the Power of Attorney holder.

Accordingly, the application is allowed as per the prayer made in the application.

The application stands disposed of.
