This is a petition seeking direction of this Court to the Tahsildar and Sub Divisional Officer (S.D.O.), Tiroda, District Gondia to release the vehicle bearing No.MH-35-AJ3101, which has been seized under Section 48(8) of the Maharashtra Land Revenue Code, 1966. Learned counsel for the Petitioner also seeks quashing and setting aside of the notices dated 22.09.2022 and 27.09.2022, issued to the Petitioner.

Ms Jaipurkar, learned Assistant Government Pleader submits that the matter is pending for reply before S.D.O., who will pass an order after hearing the Petitioner. 3.
Shri Ingole, learned counsel for the Petitioner submits that the reply has already been filed, but not considered by the S.D.O. and now a second show cause notice dated 27.09.2022 has been issued. He would submit that the Petitioner's livelihood is dependent on the seized vehicle and if the same is not released, there will be grave injustice caused to the Petitioner.

Having heard learned counsel appearing for the parties, this Court is of the view that the interests of justice would be served, if the S.D.O., who has seized the vehicle, hears the matter expeditiously after considering the reply filed by the Petitioner.

Let the matter be heard by the S.D.O. on 04.11.2022 and an appropriate order be passed in accordance with law after hearing the parties and after considering the submissions made by them. Petition accordingly stands disposed in above terms.
