Heard Shri Sunil Manohar, learned Senior Advocate a/b Shri Aditya Mane-Patil, advocate for the applicant and Shri S.S. Doifode, A.P.P. for the non-applicant. The learned Senior Advocate, on instructions, seeks permission to withdraw the application. It is disposed of accordingly.

Pursuant to the order passed by this Court on 27th November, 2015, the applicant has filed pursis dated 29th February, 2016 giving details of the properties. A copy of the pursis is supplied to Shri S.S.Doifode, learned A.P.P. for the non-applicant.

In response to the order passed by this Court on 3rd February, 2016 the learned A.P.P. has submitted that the crime is not registered against any of the Bank officers. Considering the nature of the accusations, which relate to insensitivity of the officers of the Co-operative Bank towards the goods hypothecated while securing loan, it would be appropriate that the Investigating Officer shall place all the

2 ba819.15 papers and the details of the pursis dated 29th February, 2016 given by the applicant today before the Superintendent of Police, Yavatmal within one week.

The Superintendent of Police shall examine as to whether the crime should be registered against the Bank officers who are responsible for not keeping proper control over the hypothecated goods. The Superintendent of Police may also take appropriate steps for attachment of the properties of the applicant, details of which are given in the pursis.
