Mr. R.L.Khapre, learned Senior Advocate for the State Government seeks modification of the order of status quo as operating on the ground that pursuant to the interim directions issued at the Aurangabad Bench in Writ Petition No.8117/2022 and 9897/2022, the State Government has now issued directions to the Director of Marketing, Pune on 16.11.2022 to appoint Government Administrators on Market Committees wherever the term of the elected Board of Directors has come to an end or the term of the Administrative Board has come to an end. He submits that a Government Administrator be permitted to be appointed to manage the affairs of the Petitioner-Market Committee in terms of communication dated 16.11.2022.

Mr.V.D. Hon, learned Senior Advocate for the Petitioner on instructions, submits that in view of the communication dated 16.11.2022 issued by the State Government proposing to appoint an independent Administrator/ Board of Administrators on the Market Committee there would be no objection if such Administrator/Board of Administrators consisting of Government officers is appointed to manage the affairs of the Petitioner-MarketCommittee. 4.

Accordingly, it is directed that by modifying the interim order of status quo that the Respondent No.2 is free to proceed in accordance with the directions issued on 16.11.2022 by the Ministry of Cooperation, Marketing and Textiles and appoint an Administrator/ Board of Administrators consisting of Government officers on the petitioner-Market Committee.

The Writ Petition is accordingly disposed of in aforesaid terms, with no order as to costs.
