Heard Mr. Topale, learned counsel for the applicant. By the present application, the delay of 73 days occurred in filing of the second appeal is sought to be condoned. It is submitted that the applicant is an agriculturist aged 80 years and was suffering from ailments which has occasioned the delay. It is also submitted that there was paucity of funds and it took time to arrange them. Considering the reasons given the delay is condoned. The civil application is allowed and disposed of.
