CORAM : SMT. VASANTI A NAIK AND MRS. SWAPNA JOSHI, JJ.

DATED : NOVEMBER 21, 2016.

By this writ petition, the petitioner has sought a direction against the Scrutiny Committee to decide the caste claim of the petitioner within a time frame. The petitioner has sought a direction against the respondent nos.2 to 4 to release the retiral benefits in favour of the petitioner.

Shri S.P. Deshpande, the learned Additional Government Pleader appearing for the respondent-Scrutiny Committee states, on instructions from the Scrutiny Committee that the petitioner is called for hearing before the Scrutiny Committee on 30.11.2016 and within four weeks from that date, the petitioner's caste claim would be decided.

By accepting the statement made on behalf of the Scrutiny Committee that would be binding on the Scrutiny Committee, we dispose of the writ petition with no order as to costs. It is needless to mention that an appropriate action would be taken in the matter of releasing the retiral and other monetary benefits to the petitioner after the Scrutiny Committee decides the caste claim. Order accordingly. No costs.
