Shri N.S. Khubalkar, learned Assistant Government Pleader for the respondent Nos.1 and 2. The petitioners have challenged the order passed by the learned Additional Collector disqualifying the petitioners from continuing as the Sarpanch and UpSarpanch of the village. The disqualification of the petitioners was under Section 14(h) of the Bombay Village Panchayats Act, 1958. The petitioners have also challenged the order passed by the learned Commissioner in appeal, by which he has maintained the order passed by the learned Additional Collector. The petitioners were elected in 2004. The term of member of village panchayat is of five years. It appears that the term of the petitioners is over and therefore, the petition is rendered infructuous. It is disposed accordingly. No costs.
