Issue notice to the non-applicant/State.

Shri S.S. Doifode, learned A.P.P. waives notice on behalf of the State and seeks time to file reply. The learned A.P.P. submits that since the application filed for grant of anticipatory bail in Crime No.189/2016 has already been finally heard by the Sessions Court and it is now fixed for passing of order on 04/10/2016, this application is not tenable and, therefore, it can be disposed of summararily. The learned Counsel for the applicant submits that difficulty for the applicant is that he has been directed by this Court to attend Police Station Bhandara for a period of one week staring from 4th October, 2016 and if he attends Police Station Bhandara on 4th October, 2016, there is every possibility of his being arrested in the crime subsequently registered and in that

aba.652.16 2 case, this application for anticipatory bail shall be rendered infructuous.

In view of the difficulty expressed by the applicant, I am of the view that the purpose of this application and also the interest of justice shall be served by issuing a direction to the Police Station Lakadganj that till the Sessions Court finally disposes of the application filed in Crime No.274/2016, in accordance with law, the applicant shall not be arrested. The learned Sessions Judge Nagpur shall not be influenced in any manner by this order. The application is disposed of.
