The learned advocate for the respondent strongly objected the application and submitted that, there is no sufficient reason to condone the delay. 7.

Considering the reasons stated in the application, it appears that, delay has not been deliberately caused, the application deserves to be allowed in the interest of justice.

The application is allowed. Delay of 117 days caused for filing first appeal is condoned.
