Heard Mrs. P.P. Chobe, learned Counsel for the applicants, Shri A.A. Mardikar, learned Counsel for non-applicant no.1 and Shri V.A. Thakare, learned A.P.P. for non-applicant no.2.

Applicant no.1 is present with his Counsel and non-applicant no.1 is also present with her counsel. A dispute under Section 498-A of Indian Penal Code forms subject matter of the present proceeding.

Parties state that matrimonial controversy is amicably settled between them and all terms and conditions therein, except for handing over of custody

of girl child, are complied with. Custody of girl child by name "Aarohi" is with non-applicant no.1 and it is to be handed over to applicant no.1 on 05.11.2016 i.e. the date on which the Family Court, Nagpur shall be passing the decree of divorce.

In view of this statement and joint request made by the parties with their counsel, we make Rule absolute in terms of prayer clause (i). No costs. JUDGE JUDGE Rgd.
