Present appeal is preferred by the appellant, who is the original defendant in the suit bearing RCS No.119/2015 which was filed for cancellation of sale deed and possession of field. The trial Court has decreed the suit; against the said decree the Regular Civil Appeal No.87/2018 was filed by the present appellants. The said appeal was also dismissed and therefore, present appeal. During the pendency of this appeal, both parties have settled the dispute through the mediation. The Mediation report is on record, which shows that dispute is settled, as per the settlement, both parties decided to withdraw the suit bearing RCS No. 119/2015. It was agreed that the appellant shall pay an amount of Rs.4,00,000/- to the respondent. The amount is received by the respondent Mangalabai, who is present before the Court. (2) 54.sa.446.2022 mentioned in the settlement agreement are agreed and accepted by both the parties.

In view of that, the appeal is to be disposed of and decree be drawn up in view of the settlement.
