Heard Shri N.L. Jaiswal, learned counsel for the petitioner and Shri S.M. Ukey, learned Additional GP for the respondent.

The communication dated 01.11.2017 sent by the Collector, Nagpur, to the petitioner is taken on record as Exh. "X". According to the learned Additional GP, the communication is in obedience to the order dated 01.12.2016.

Shri Jaiswal, learned counsel submits that the communication aggravates the contempt. According to him, it points out earlier order and, therefore, the Collector has refused to pass fresh orders.

We keep the said contention open. The order has been passed by the Collector mentioning directions issued by this Court on 01.11.2016 in Writ Petition No. 5890 of 2016.

In this situation, with liberty to the petitioner to raise said contention again while challenging the said communication in writ petition, we dispose of the present proceedings. No costs.
