This is an application for anticipatory bail. Applicant is apprehending his arrest in connection with Crime No. 471/2015 registered with Police Station, Gittikhadan, Nagpur for the offences punishable under Sections 294, 323, 3543, 504, 506 read with Section 3 (1) (x) of the Prevention of Atrocities Act. 2.

The First Information Report is lodged by Manda on 4.10.2015. From the FIR, it is clear that at the time when her husband was taking bath, her neighbour Ramlal Yadav parked his motor-cycle in front of the gate of the first-informant's house, thereby causing obstruction. Therefore, the first-informant took photograph of the said motor-cycle in her cellphone and then disclosed to Ramlal that now she will be going to Police Station for showing the said photograph and proceeded to the Police Station. When she returned from the Police Station to her house at about 10.15 am, Ramlal used abusive words in the name of caste against the first-informant. That time, when the husband of first-informant stepped outside the house, Ramlal Yadav gave first blows to her husband. 3.

Specific allegations about using of abusing language in the name of caste are against co-accused Ramlal. The allegation against the present applicant is that he used to instigate others. In that view of the matter, application of the applicant can be considered favourably. Hence, the following order :

ORDER

I.

Application is allowed.

II.

In the event of his arrest in connection with Crime No. 471/2015 registered with Police Station, Gittikhadan, Nagpur for the offences punishable under Sections 294, 323, 3543, 504, 506 read with Section 3 (1) (x) of the Prevention of Atrocities Act, applicant Pravin Namdeorao Mate be released on bail on he executing PR Bond of Rs. 25,000/- with one solvent surety in the like amount. III.

With this, application is allowed and disposed of. Judge joshi
