In the backdrop of order dated 17th November, 2016 passed in the present matter the learned A.P.P. has invited our attention to Pursis filed by him at Stamp No. 4170 of 2016 on 01/12/2016 with communication dated 23rd November, 2016 received by his office from Medical Superintendent, Regional Mental Hospital, Nagpur. 3.

Perusal of communication dated 23rd November, 2016 reveals that the applicant / appellant is not the person of unsound mind.

In this situation, after hearing respective counsel, we find no case made out warranting suspension of sentence.
