Considering the facts of the case and the nature of challenges in the appeal, the respondent No.1-claimant is permitted to withdraw Rs.5,00,000/- unconditionally. In addition, the respondent No.1-Claimant be given Rs.3,00,000/- on furnishing solvent surety/ security to the satisfaction of the Registrar (Judicial) of this Court. The balance amount be continued in fixed deposit in a nationalized bank till disposal of the appeal. The civil application is allowed in the above terms.
