CORAM : B. P. DHARMADHIKARI & V.M. DESHPANDE, JJ.
DATE : APRIL 17, 2017.
Heard Shri T. Mandlekar, learned Counsel for the petitioner and Shri S.S. Doifode, learned A.P.P. for respondent nos. 1 and 2, for some time. 2.
We find material placed on record by both the parties insufficient to conclusively fasten responsibility on any driver.
3.
Both the learned Counsel are seeking time to obtain further instructions and file papers. 4.
Petitioner before this Court is father of one of the deceased in the accident. We therefore, find that he has got remedy of recovering compensation as
Order 1704wp783.16 per law before the Motor Accident Claims Tribunal. If investigation in criminal offence has not been carried out properly, it is most appropriate that a suitable private grievance is made before the concerned Judicial Magistrate First Class. Hence, with these observations and leaving all rival contentions open, we dispose of the present Writ Petition. No costs. JUDGE JUDGE Rgd.
