Applicants are apprehending their arrest in connection with Crime No.331/2019 registered with Old City Akola Police Station, District Akola for offences under Sections 306, 498-A read with Section 34 of the Indian Penal Code.

Heard learned counsel Shri A.R.Deshpande for applicants and learned Additional Public Prosecutor Shri N.B.Jawade for the State. Also, perused reply filed on behalf of the prosecuting agency.

First Information Report is lodged by Dayawati Dilip More in respect of suicidal death of her daughter Amrapali. Amrapali committed suicide at her matrimonial house on 2.9.2019 by hanging herself. Marriage of Amrapali with Nilesh Ingale was performed on 29.5.2019. Present applicant No.2 is sister-in-law and applicant No.2 is her husband of deceased Amrapali. Both applicants are residing at Akola. Amrapali, the deceased, along with her husband used to reside at village Khamkhed.

Reply shows that applicants used to give taunt to Amrapali for not bringing amount. The said is only material against the applicants.

This Court, on 24.9.2019 protected applicants with direction that only applicant No.1Gajanan s/o Vitthal Hiwrale shall attend police station from 26.9.2019 to 28.9.2019 and shall be with Investigating Officer from 11:00 a.m. to 5:00 p.m. and shall extend cooperation to Investigating Officer. Reply filed on behalf of the State shows that applicant No.1 joined investigation and attended police station. 6.

Looking to nature of accusation made against the present applicants, following order is passed:

ORDER

(a) The criminal application is allowed.

(b) In the event of arrest of applicant No.1-Gajanan s/o Vitthal Hiwrale and applicant No.2- Varsha w/o Gajanan Hiwrale, in connection with Crime No.331/2019 registered with Old City Akola Police Station, District Akola for offences under Sections 306, 498-A read with Section 34 of the Indian Penal Code, they be released on bail on they executing a P.R.Bond in the sum of Rs.10,000/- with one solvent surety of the like amount. (c) With this, the criminal application stands disposed of accordingly.
