This application is filed for suspension of substantiative sentence imposed upon the applicant/appellant contending that the punishment imposed is of three years only and pending trial the appellant was on bail.

Perused the record. It appears that the applicant came to be convicted for the offence punishable under Section 315 of the Indian Penal Code and sentenced to suffer rigorous imprisonment for three years and to pay a fine of Rs.3000/- and in default of payment of fine to suffer simple imprisonment for six months. Fine amount is admittedly paid by the applicant. Considering the fact that the applicant was on bail pending trial and as she is imposed with short sentence, application is allowed as per following order.

2811APPA662 2/2 The applicant/appellant Savita @ Ganga Rameshrao Ambazare shall be released on bail on her executing P.R. Bond in the sum of Rs.20,000/- with one solvent surety in the like amount.

While on bail, the applicant shall mark his presence with Police Station Wardha, between 9 a.m. and 11.a.m., once in six months on 1st day of such month, pending trial. JUDGE chute
