Heard the learned Counsel for the rival parties.
It is not in dispute that the identical nature of civil suit is pending before the competent civil Court between the parties. The impugned order in the present Writ Petition is under Section 145 of the Code of Criminal Procedure. It is trite law that the orders and the proceedings under Section 145 of the Code of Criminal Procedure are subject to the outcome of the Civil Suit so also the interim orders issued by the civil Court, if any. That being so, I make the following order :-
Order Criminal Writ Petition No.746 of 2013 is disposed of holding that the impugned orders are subject to the outcome of the Civil Suit so also the interim orders issued by the civil Court.
