Learned APP submitted that now trial is already commenced and chief-examination of the complainant is recorded, but due to the absence of learned Counsel for the applicant/accused the crossexamination is not completed on that day. 3.

Considering the trial is already commenced. Learned Counsel for the applicant seeks permission to withdraw the application with liberty to file afresh after three months, if there is no substantial progress in the trial.
