SEPTEMBER 26, 2017 Heard Mr. S.V. Sirpurkar, Advocate for applicant and Mr. R.S. Nayak, A.P.P. for non applicant. The applicant is apprehending his arrest in connection with Crime No.94/2017 registered with Police Station, Paratwada, Tq. Achalpur, Dist. Amravati for an offence punishable under Section 366, 323, 504, 342 and 500 of the Indian Penal Code.
FIR is lodged by victim herself on 22.02.2017. The victim is a married woman and is having one daughter aged 11 years and one son aged 5 years. Prior to the filing of the FIR, the husband of the victim informed to the Police Station on 16.02.2017 that the victim has left the house without giving intimation to anybody. On that, a missing report was lodged. In that missing report, statement of husband of the victim was recorded, which clearly shows that there was a love affair between the victim and the present applicant.
aba676.17.odt The victim returned to her house on 18.02.2017. Thereafter, she approached to the Police Station, Paratwada and her statement was recorded on 18.02.2017. In the said statement also, she has stated that she was having love affair with the applicant and that has resulted into dispute between herself and her husband and on her own she left her matrimonial house. Even thereafter after lapse of four days, the FIR in question is filed against the present applicant. Looking to the aforesaid, I am of the view that the applicant is entitled to be released on bail. Hence, I pass the following order.
ORDER
(i) Criminal Application No.676/2017 is allowed.
(ii) In the event of arrest of applicant-Rahul Purushottam Ingle in connection with Crime No.94/2017 registered with Police Station, Paratwada, Tq. Achalpur, Dist. Amravati for an offence punishable under Sections 366, 323, 504, 342, 500 of the Indian Penal Code, he be released on bail on he executing PR Bond in the sum of Rs.25,000/- with one solvent surety in the like amount. The application stands disposed of.
