The learned counsel for the petitioner seeks leave to withdraw the writ petition so as to approach the civil Court to raise a challenge to the E-Auction notice dated 07.09.2023 in view of the decision in Bank of Baroda, Khamgaon Versus Gopal Shriram Panda [2021(4) ABR 64]. 2.

The writ petition is permitted to be withdrawn. The same is disposed of. All points raised on merits are kept open.
