Since the efforts for mediation are reported to have failed, Misc. Civil Application No.1177 of 2014 is taken up for hearing.
Present Misc. Civil Application is filed by the applicant for transfer of Petition No.A-72/13 pending in the Family Court at Amravati to the Family Court at Nagpur on the ground that the applicant/wife is having two minor daughters namely Ku.Vidhi, aged about 8 years and Ekta, aged about two years. They are all residing at Nagpur with the applicant. The applicant is residing with her brother at Nagpur and therefore, since Divorce Petition is pending in the Family Court at Amravati, the applicant wants that petition to be transferred to the Family Court at Nagpur so that she will find it convenient to oppose the petition. It is submitted by the applicant that Criminal Complaint No.3538 of 2014 is pending in the Court of Judicial

That being so, it will be convenient for the applicant to prosecute the complaint as well at Nagpur instead of travelling to the distance of 200 kms. away from Nagpur on each date. This application is pending since October, 2014 and mediation is not possible. Hence, the application is allowed in terms of prayer clause (A) therein, though opposed. No order as to costs.
