Learned Counsel for the applicant submitted that appeal is preferred challenging the judgment and order passed by the learned Judicial Magistrate First Class, Court No.3, Amravati by which the respondent is acquitted from the offence punishable under Section 138 of the Negotiable Instruments Act. During pendency of this appeal, respondent reported to be dead therefore, the appeal abates.

In view of that, the application is disposed of along with the appeal.
