DATE : 04.02.2015 Though the respondents are opposing the applications, considering the fact that the first appeal was admitted and pending for final hearing and accepting the reasons given in the application, the delay is condoned. The first appeal is restored. The appellant shall file private paper-book within eight weeks, failing which the appeal shall stand dismissed without reference to this Court with costs, quantified at Rs.5,000/- (Rupees Five Thousand Only) to be paid by the appellant to the respondents. The civil application and the misc. civil application are allowed in the above terms.
