The applicant/appellant seeks suspension of sentence in Special (POCSO) Case No.119/2020, wherein the applicant has been convicted for the offence punishable under Section 354-A(i) of the Indian Penal Code and sentenced to suffer rigorous imprisonment for two years and to pay fine of Rs.1,000/- and in default, rigorous imprisonment for three months.

02] Heard the learned Counsel for the applicant as well as the learned A.P.P. for the State.

03] Considering the fact that the applicant has paid the fine amount and during pendency of the trial, the applicant was on bail and also considering the fact that this appeal may not come up for final hearing in near future due to heavy pendency of the appeals before this Court, a case is made out for suspension of sentence and grant of bail. Hence, the following order :

The substantive sentence of the applicant shall remain suspended during pendency of the appeal.

ii. The applicant shall be released on bail on his furnishing a P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount before the trial Court by giving an undertaking that he shall appear before the Court as and when directed.

iii. The application is allowed and disposed of in the aforesaid terms.
