The respondent No.2 (owner of the vehicle) has filed cross-objection and in that cross-objection this civil application is filed praying that the requirement of depositing Rs.25,000/- as per Section 173(1) of the Motor Vehicles Act, 1988 and Rule 12-A of Chapter IV of the Bombay High Court Appellate Side Rules, 1960 be dispensed with. On instructions, the learned advocate for the respondent No.2/cross-objector seeks permission to withdraw the cross-objection with liberty to file appeal. The cross-objection is disposed accordingly with liberty as prayed for.
In view of withdrawal of the cross-objection, the civil application does not survive and it is disposed accordingly.
