DATED : SEPTEMBER 5, 2017 Heard learned counsel for the applicant for quite some time. During the course of hearing it is noticed that instead of challenging the impugned order by filing the revision the applicant has preferred the present application under Section 482 of Code of Criminal Procedure. The learned counsel for the applicant submits that he wish to withdraw the present application and will file revision before the revisional court challenging the impugned order.

In view of the prayer made by the learned counsel for the applicant,present application is allowed to be withdrawn with a liberty to the applicant to file revision before the learned revisional Court. If the revision is filed within a period of four weeks from today, the interim order granted by this Court on 9/12/2016 shall remain in operation for further six weeks. If revision is filed within a period of four weeks and is accompanied with the application for condonation of delay the revisional Court shall consider the said application sympathetically keeping in mind the provisions of the Limitation Act and pendency of the present

apl.787.15.odt application before this Court. The interim order grated on 19/12/2016,shall remain in operation for a further period of six weeks . After expiry of six weeks the interim order shall cease to operate automatically.
