The applicant is seeking pre-arrest bail in connection with Crime No. 492/2022, registered with Police Station Bhadrawati, Dist. Chandrapur for the offences punishable under Sections 376 and 506 of the Indian Penal Code,1860. 3.

It is alleged in the complaint dated 02/02/2022, that the applicant forcibly committed sexual intercourse with the informant. The said incident was reported to the Police on 12/10/2022, after more than eight months without sufficient justification for such a huge delay. 4.

Thus, considering the nature of the allegation and the delay, I am of the opinion that, custodial interrogation of the applicant is not necessary. Accordingly, I pass the following order:

a) The criminal application is allowed.

c) The applicant shall attend the concerned police station as and when his presence is required.
