SEPTEMBER 19, 2017 Heard Shri S.G.Karmarkar, learned counsel for original applicant in CRA, Shri Anand Deshpande, learned AGP for respondent no.1 and respondent no.2-Madhaorao Deorao Nigut is personally present.

There is a proposal of the State Government to make some ex-gratia payment and also to consider allotment of plot of land. Permission has been sought for allowing the Government to make payment and the allotment.

Permission is granted to the State Government to go ahead with this proposal for making ex-gratia payment and allotment of plot. But, the same would be done by keeping respondent no.2 out of consideration for the present.

CP370.2016 Considering the fact that, now the State Government has started taking steps and taking concrete action, I am of the view that for the present personal presence of Shri Ravindra Kumbhare, Deputy Collector, before this Court is not necessary and therefore, his personal presence is exempted until further orders.

All the amount on account of ex-gratia payment shall be deposited in this Court within a week's time. The amount shall not be allowed to be withdrawn till apportionment and shares of the claimants are determined by Mihan Court.

C.A.(N) No.85/2017 is disposed of in the above terms.
